§ 1
Preliminary Provisions

The online store - E-GOLAB.pl, available at www.e-golab.pl, is operated by Wiktor Furman running a business under the name P.P.H.U INVESTMENTS WIKTOR FURMAN, NIP 6492311073, with its registered office at 42-450 Niegowonice, ul. Zagórczańska 15.

These Terms and Conditions are addressed to Consumers and define the rules and procedures for concluding Distance Sales Agreements with Consumers via the Store.

§ 4
Technical Requirements

To use the Store, including browsing the product range and placing orders for Products, the following are required:

an end device with Internet access and a web browser,
-
an active e-mail account,
-
enabled cookies support,
-
installed FlashPlayer program.
§ 5
General Information
The Seller shall not be liable, to the fullest extent permitted by law, for any disruptions, including interruptions in the operation of the Store caused by force majeure, unlawful acts of third parties, or incompatibility of the online Store with the Customer’s technical infrastructure.
Browsing the Store’s assortment does not require creating an Account. Placing orders for Products available in the Store is possible either after creating an Account according to § 6 of the Terms or by providing necessary personal and address data allowing order fulfillment without creating an Account.
Prices shown in the Store are given in Polish zloty (PLN) and are gross prices (including VAT).
The final amount payable by the Customer consists of the price of the Product and the delivery cost (including transport, delivery, and postal service fees), which the Customer is informed about on the Store’s website during the ordering process, including at the moment of expressing the will to conclude the Sales Agreement.
In the case of an Agreement including subscription or indefinite duration service provision, the final price is the total price covering all payments for the billing period.
If the nature of the subject of the Agreement does not allow, reasonably, the prior calculation of the final price, information on how the price will be calculated, as well as delivery, transport, postal service fees, and other costs will be provided in the Product description in the Store.
§ 6
Creating an Account in the Store
To create an Account in the Store, one must complete the registration form.
Creating an Account in the Store is free of charge.
Logging into the Account is done by providing the login and password set in the registration form.
The Customer may delete their Account at any time without giving any reason and without any fees by sending a relevant request to the Seller, especially by e-mail or in writing to the addresses given in § 3.
§ 7
Order Placement Rules
To place an order, the Customer should:

optionally log into the Store;
-
select the Product and click “Add to cart” (or equivalent);
-
log in or use the option to place an order without registration;
-
if placing an order without registration, fill out the order form with recipient data and delivery address, select delivery method, enter invoicing data if different from the recipient’s data;
-
click the “Order and pay” button and confirm the order by clicking the link sent in the e-mail;
-
choose a payment method and pay within the specified time, subject to § 8 point 3.
The order processing time is counted from the moment of successful payment authorization.
§ 8
Offered Delivery and Payment Methods
The Customer may use the following delivery or product pickup methods:

Postal shipment, cash on delivery postal shipment,

The Customer may use the following payment methods: -

Payment by credit/debit card: Visa, Visa Electron, MasterCard, Master Card Electronic, Maestro
Detailed information about delivery and payment methods is available on the Store’s website.

§ 9
Execution of the Sales Agreement
The Sales Agreement between the Customer and the Seller is concluded after the Customer places an order via the order form in the online Store according to § 7.
After placing the order, the Seller immediately confirms receipt and simultaneously accepts the order for processing. The confirmation is sent by e-mail to the Customer’s address provided during the order and includes at least the Seller’s statements about receiving and accepting the order and confirming the conclusion of the Sales Agreement.
The Sales Agreement is concluded upon the Customer’s receipt of this e-mail.
If the Customer chooses a delivery method other than personal pickup, the Product will be sent within the time indicated in its description (subject to paragraph 5 of this section), using the delivery method selected by the Customer.
If Products with different delivery times are ordered, the delivery time is the longest indicated time.
The delivery period starts:

For bank transfers, electronic payments, or card payments, the Customer must make the payment on the day of concluding the Sales Agreement; otherwise, the order will be canceled.

For cash on delivery payments, the Customer must pay upon receipt.
-
For cash payments during personal pickup, payment must be made on the day of pickup.
If Products with different delivery times are ordered, the Customer may request partial deliveries or delivery of all Products once the entire order is ready.
For payments by bank transfer, electronic payment, or card, delivery time counts from the moment the Seller’s bank account is credited.
For cash on delivery payments, delivery time counts from the date of Sales Agreement conclusion.
For personal pickup, the Product will be ready at the date indicated in its description. The Customer will be informed by e-mail about the readiness for pickup.
Partial pickup of Products is possible if they have different readiness dates.
The delivery period for pickup starts: -
For bank transfers, electronic payments, or card payments, from the date the Seller’s bank account is credited.

For cash payments at pickup, from the date of Sales Agreement conclusion.
Delivery is available only within Poland.
Delivery costs are charged unless stated otherwise in the Agreement. These costs are shown in the “Delivery Costs” section of the Store and during order placement.
Personal pickup is free of charge.
§ 10
Right of withdrawal from the contract

The Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.

The withdrawal period specified in section 1 begins from the day the Product is delivered to the Consumer or to a person indicated by them other than the carrier.

In the case of an Agreement covering multiple Products delivered separately, in batches or in parts, the period specified in section 1 starts from the delivery of the last item, batch, or part.
-
In the case of an Agreement involving regular delivery of Products for a fixed period (subscription), the period specified in section 1 starts from the possession of the first item.

The Consumer may withdraw from the Agreement by submitting a statement to the Seller. To meet the withdrawal deadline, it is sufficient for the Consumer to send the statement before the deadline expires.

The statement can be sent by traditional mail, fax, or electronically by sending the statement to the Seller’s email address or by submitting the statement on the Seller’s website – the Seller’s contact details are specified in § 3. The statement can also be submitted using the form, the template of which is an appendix no. 1 to this Terms and Conditions and an appendix to the Act of 30 May 2014 on Consumer Rights, but this is not obligatory.

If the Consumer sends the statement electronically, the Seller shall immediately send confirmation of receipt of the withdrawal statement to the Consumer’s provided email address.

Effects of withdrawal from the Agreement:
-
The statement may be sent by traditional mail to the Seller’s address – contact details in § 3. The statement can also be submitted using the form as above, which is not mandatory.

In case of withdrawal from a distance contract, the Agreement shall be considered not concluded.

Upon withdrawal, the Seller shall refund all payments made by the Consumer, including delivery costs (except additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest standard delivery offered by the Seller) immediately, but no later than 14 days from receipt of the withdrawal statement.

If payment was made by card, the refund will be made to the card account used for payment.

Refunds will be made using the same payment methods as the Consumer used, unless the Consumer explicitly agrees otherwise without incurring any costs.

The Seller may withhold the refund until the Product is returned or proof of return is provided, whichever occurs first.
-

The Consumer must return the Product to the Seller’s address given in these Terms and Conditions without undue delay, no later than 14 days from informing the Seller of withdrawal. The deadline is met if the Product is sent before the 14-day period expires.

The Consumer bears the direct costs of returning the Product, including costs if the Product’s nature prevents its return by regular mail.

The Consumer is liable only for any diminished value of the Product resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the Product.

If, due to the nature of the Product, it cannot be returned by regular mail, this information and return costs will be included in the Product description in the Store.

The right of withdrawal does not apply to contracts:
-
for goods made to the Consumer’s specification or customized,
-
for sealed goods that cannot be returned for health or hygiene reasons if unsealed after delivery,
-
for goods that deteriorate quickly or have a short expiration date,
-
for services fully performed with the Consumer’s prior explicit consent and acknowledgment of losing withdrawal rights,
-
where price depends on financial market fluctuations outside the Seller’s control,
-
for goods inseparably mixed after delivery,
-
for alcoholic beverages with agreed price, delivery after 30 days, value dependent on market fluctuations,
-
for sealed audio/video recordings or software if opened after delivery,
-
for delivery of newspapers, periodicals or magazines except subscription contracts,
-
for delivery of digital content not on a physical medium if performance started with Consumer’s consent and acknowledgment of losing withdrawal rights.

§ 11
Complaints and warranty

The Sales Agreement covers new Products.
-
The Seller is obliged to deliver to the Customer an item free from defects.
-
In case of defects, the Customer has the right to make complaints based on warranty provisions of the Civil Code.
-
Complaints should be submitted in writing or electronically to the Seller’s addresses provided in these Terms and Conditions.
-
It is recommended to include a concise description of the defect, circumstances (including date), Customer’s data, and request related to the defect.
-
The Seller shall respond without delay, no later than within 14 days; if no response is given, the complaint is deemed justified.
-
Goods sent for complaints should be sent to the address specified in § 3.
-
If a warranty applies, its details will be included in the Product description in the Store.
-
Complaints can also be submitted electronically via a complaint form provided by the Seller on the Store website.
-
For Consumers, the Seller must respond within 14 days; otherwise, the complaint is considered accepted.

§ 12
Out-of-court complaint handling and claims
Detailed information on possibilities of out-of-court complaint handling and claims procedures, and access rules, are available at the offices and websites of district (municipal) consumer ombudsmen, social organizations protecting consumers, Provincial Trade Inspection, and at:
Consumers have the following example options for out-of-court complaint handling and claims:

Applying to the permanent consumer arbitration court referred to in Art. 37 of the Act of 15 December 2000 on Trade Inspection,
-
Applying to the provincial inspector of Trade Inspection to start mediation proceedings,
-
Obtaining free assistance from municipal consumer ombudsmen or social organizations protecting consumers (e.g., Consumers’ Federation, Polish Consumers’ Association).
§ 13
Personal data in the online Store

The administrator of Customers’ personal data collected via the online Store is the Seller.
-
Customer data collected are used for fulfilling the Sales Agreement and, if consent is given, also for marketing purposes.
-
Recipients of personal data may include:
-
Carriers or intermediaries handling shipments, if delivery is by post or courier,
-
Entities processing electronic or card payments if those payment methods are used.
-

Customers have the right to access and correct their data.
-
Providing personal data is voluntary, but failure to provide data necessary for the Sales Agreement prevents concluding the Agreement.
§ 14
Final provisions

Contracts concluded through the online Store are in Polish.
-
The Seller reserves the right to amend the Terms and Conditions for important reasons, such as changes in law, payment, or delivery methods affecting these Terms. Customers will be informed at least 7 days in advance.

Matters not regulated by these Terms are governed by generally applicable Polish law, in particular the Civil Code, the Act on Electronic Services, the Consumer Rights Act, and the Personal Data Protection Act.
